Direct Pay-for-Sex

Thought of this while hearing similar comment on The Drive today...

Why come pay for sex is illegal unless you video it?

And would this be a satisfactory defense if one was busted in the act: Officer, this is not solicitation/prostitution. I am making a Porno film!

This line of thinking blows up 100% if porno-making requires a government permit or somesuch... Which wouldn't surprise me.

I really like this question. I really don't have an answer.

:-k

Were you considering something that we should know about?
why don't you run back to the sandbox where the rest of the kids are playing so the adults can have a discussion...it's over there....you see Howie, he's over there with PMS knocking over other kids sandcastles...looks like fun.

Best as I can tell because porn actors aren't paid for their own sexual arousal or that of the person paying them (http://supreme.justia.com/us/488/1311/)

Also, according to some ruling called Miller v. California, porn is protected as long as it has "serious literary, artistic, political, or scientific value." Porn directors can claim the performers are just actors and they are filmmakers and get away from it.

In a moral context though? Yeah, it doesn't really make much sense.

Are you trying to say that "Say Aloha To My A-hole-a" does not have serious literary, artistic, political or scientific value?

It's not as artistic as "Strollin In My Colon", but it's close.

So there is no artistic, Political, Or scientic value in non- video'd sex.

Got it. So "I'm just practicing my art" is not an excuse. Unless you tape and sell it.
